These Terms and Conditions ("Terms") govern your use of the website thekollektiv.com.au and any purchase you make from The Kollektiv, whether online, in our Kalbar store, or at a market/event. By accessing our website or making a purchase, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

We may update these Terms from time to time. The current version will always be published on our website with the date of last update. Continued use of our website or services after any update constitutes your acceptance of the revised Terms.

The Kollektiv offers the following products and services:

  • Active and leisure wear and lifestyle products available for purchase in-store, online, and at markets/events

  • Golf equipment, accessories, and related products

  • Golf coaching and player development services, including Get Into Golf programmes through the Golf Australia platform

  • Equipment services including regripping and shaft repair

  • Putting simulator sessions

  • Gift cards

Product descriptions, images, and specifications on our website are provided in good faith. We reserve the right to correct any errors, inaccuracies, or omissions and to update information at any time without prior notice.

We reserve the right to limit the quantities of any product or service we offer, and to discontinue any product or service at any time.

PLACING AN ORDER

Online Orders

When you place an order through our website, you are making an offer to purchase the selected products. Your order is not confirmed until you receive an order confirmation email from us.

We reserve the right to cancel or refuse any order for any reason, including but not limited to: product unavailability, errors in pricing or product information, suspected fraudulent activity, or failure of payment authorisation. If we cancel your order, you will receive a full refund to your original payment method.

You are responsible for ensuring that all information you provide when placing an order, including your delivery address and contact details is accurate and complete. We accept no liability for orders delayed or undelivered due to incorrect information provided by you.

In-store and Market/Event Purchases

All in-store and market/events sales are governed by these Terms where applicable, and by the Australian Consumer Law. Proof of purchase is required for any returns, exchanges, or warranty claims.

PRICING AND PAYMENT

All prices displayed on our website and in-store are in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed.

Online payments are processed securely through Stripe and Square. We do not store your payment card details. By providing your payment information, you confirm that you are authorised to use the payment method provided.

In the event of a pricing error on our website or in-store, we are not obliged to honour the incorrect price. We will notify you of any error and give you the option to proceed at the correct price or cancel your order with a full refund.

SHIPPING

Shipping terms for online orders are set out in our Shipping Policy, which forms part of these Terms. By placing an online order, you agree to the terms of our Shipping Policy.

Risk of loss and damage to products passes to you upon delivery to your nominated delivery address. If you select Click & Collect, risk passes when we notify you that your order is ready for collection.

RETURNS AND REFUNDS

Our returns and refunds terms are set out in our Returns & Refunds Policy, which forms part of these Terms. Nothing in our Returns & Refunds Policy limits your rights under the Australian Consumer Law.

GIFT CARDS

The Kollektiv gift cards are subject to the following terms:

        Gift cards are valid for three years from the date of purchase, in accordance with Queensland gift card laws.

        Gift cards can be redeemed in-store, online at thekollektiv.com.au, and at markets/events.

        Gift cards cannot be exchanged for cash and have no cash value.

        Gift cards cannot be used to purchase other gift cards.

        Lost, stolen, or damaged gift cards will not be replaced.

        Gift cards are non-refundable except as required by law.

        We are not responsible for unauthorised use of a gift card.

 

If a purchase exceeds the value of a gift card, the balance must be paid by another accepted payment method. If a purchase is less than the value of a gift card, the remaining balance stays on the card.

LOYALTY AND MEMBERSHIP

The Kollektiv offers a loyalty and membership programme. Membership is subject to the following terms:

        Membership is personal and non-transferable.

        Benefits, rewards, and programme details are subject to change at our discretion. We will provide reasonable notice of material changes.

        Points or credits accumulated through the programme have no cash value and cannot be redeemed for cash.

        Points or credits expire if your account has no qualifying activity for a period of 12 months.

        We reserve the right to suspend or cancel a membership account if we reasonably suspect misuse, fraudulent activity, or a breach of these Terms.

        Membership benefits cannot be combined with other offers or promotions unless expressly stated.

COACHING AND SERVICES

Golf coaching, player development, equipment services, and putting simulator sessions offered through Golf at The Kollektiv are subject to the following terms in addition to the general terms set out above:

        Session bookings are confirmed upon receipt of payment or a booking confirmation from us.

        Cancellation and rescheduling terms are set out in our Booking and Services Terms, available on request and published on our website.

        Equipment services (including regripping and shaft repair) are non-refundable once the service has been completed, unless the work is faulty.

        We will take reasonable care of your equipment while in our possession. We are not liable for pre-existing faults or damage that is not caused by our work.

        Coaching advice and recommendations are provided in good faith based on your individual situation and are not a guarantee of any particular outcome.

        Participants in coaching sessions and simulator use do so at their own risk. Appropriate footwear and clothing are required.

INTELLECTUAL PROPERTY

All content on our website and associated materials, including text, images, logos, graphics, and product descriptions is owned by or licensed to The Kollektiv and is protected by Australian intellectual property laws.

You may not reproduce, distribute, modify, or use any of our content for commercial purposes without our prior written consent. Personal, non-commercial use is permitted provided you do not remove any copyright or proprietary notices.

Product brand names, logos, and trademarks referenced on our website remain the property of their respective owners.

WEBSITE USE

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the website.

You must not:

        use our website to transmit any unsolicited or unauthorised advertising or promotional material

        in the case of goods: replacement or repair of the goods, or payment of the cost of replacement or repair

        in the case of services: resupply of the services, or payment of the cost of resupply

 

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be lawfully excluded or limited.
